1. OBJECT
The present Terms of Use (hereinafter referred to as the “TOU”) aim to define and regulate the terms of use of the website www.mumade.fr (hereinafter referred to as the “Site”) by users (hereinafter referred to as the “Users”).
In order to access the Site and all its services, you must accept without reservation these Terms of Use in their latest version and comply with them.
2. LEGAL NOTICES

3. Services Offered by the Website
The purpose of the Site is to present, sell, and promote the Publisher’s products (hereinafter referred to as “the Services”). These Services include:
• The ability for the User to purchase or rent one or more products sold by the Publisher. To do so, the User must refer to the General Terms and Conditions of Sale available to them.
• The ability for the User to subscribe to a newsletter service, allowing them to be regularly informed about the latest news and information related to the Publisher and its products. To do so, the User must fill in their email address in the Newsletter section on the Site, where the newsletter will be sent.

For any questions, complaints, or information requests regarding the Site, or to report any illegal content or activities, the User can contact the Publisher at the email address hello@mumade.fr.
5. Acceptance of the TOU
Access to and use of the Site are subject to the acceptance and compliance with the TOU. This acceptance and compliance are deemed to be given by the User upon opening the Site.
The TOU apply, as needed, to any extension or version of the Site on existing or future social and/or community networks.
The Publisher reserves the right to modify, at any time and without notice, the Site, the Services, and the TOU, particularly to adapt to the evolution of the Site by providing new features or removing or modifying existing ones.
It is therefore advisable for the User to refer to the latest version of the TOU before navigating, which is accessible at any time on the site. In case of disagreement with the TOU, no use of the site may be made by the User.
6. Access and Navigation
Access to and navigation on the Site, allowing users to benefit from the Services, is done via an internet connection.
The Publisher implements the technical solutions available to ensure access to the Site 24 hours a day, 7 days a week.
The Publisher is obliged to use reasonable efforts to ensure access to and navigation on the Site, and makes its best efforts to guarantee this access and navigation. However, the Publisher cannot be held responsible for any malfunctions of the Site or unavailability of the Services, and shall not provide any compensation to the User in this regard.
The Publisher may at any time suspend, limit, or interrupt access to the Site or certain pages of the Site in order to perform updates, content modifications, or any other action deemed necessary for the proper functioning of the Site.
7. Responsibilities
The Publisher is only responsible for the content that it has itself published. However, it cannot guarantee the accuracy, completeness, and up-to-dateness of the information provided on the Site.
The Publisher is not responsible for:
• Technical, computer, or compatibility issues of the Site with any hardware or software;
• Direct or indirect, material or immaterial, foreseeable or unforeseeable damages resulting from the use or difficulties in using the Site or Services;
• The intrinsic characteristics of the Internet, including issues related to its lack of reliability and the insecurity of information circulating on it.
The User is responsible for the use and protection of the equipment they use to navigate the Site, the use they make of the Site and Services, and any violation of the TOU.
The following are strictly prohibited: (i) any behavior that interrupts, suspends, slows down, or prevents the proper functioning of the Site, (ii) any intrusions or attempts to intrude into the Publisher’s systems, (iii) any misuse of the Site’s system resources, (iv) any actions that impose an excessive load on its infrastructure, (v) any attacks on security and authentication measures, (vi) any acts that harm the financial, commercial, or moral rights and interests of the Publisher or its users, (vii) any use of the Site for purposes other than those for which it was designed, and (viii) any breach of the TOU or applicable laws and regulations.
It is also strictly prohibited to monetize, sell, or grant access to the Site or any information it contains, in whole or in part.
In the event of any breach of the provisions of this article or, more generally, violations of laws and regulations, the Publisher reserves the right to take all appropriate measures, seek damages, and take legal action.
8. Hyperlinks
The Site may contain hyperlinks to other websites over which the Publisher has no control. Despite prior and regular checks conducted by the Publisher, it disclaims any responsibility for the content that may be found on these sites.
Furthermore, the Publisher’s prior consent is required before any hyperlinks are created.
This authorization excludes websites that disseminate illegal, violent, controversial, pornographic, xenophobic, or content that may offend the general public.
Finally, the Publisher reserves the right to have any hyperlink pointing to its Site removed at any time if it deems it inconsistent with its editorial policy.
The Publisher is not responsible for transactions between the User and any advertiser to whom the User may be directed through the Site, and cannot be considered a party to any potential dispute in this regard.

The Personal Data collected by the company MUMADE is processed in accordance with the applicable regulations.
When using the website https://www.mumade.fr, the following data may be collected: the URL of the links through which the user accessed the site https://www.mumade.fr, the user’s Internet service provider, and the user’s Internet Protocol (IP) address.
In any case, Mumade collects personal information about the user only for the purpose of providing certain services offered by the site https://www.mumade.fr. The user provides this information knowingly, especially when they enter it themselves. The site https://www.mumade.fr will specify whether providing this information is mandatory or not.
In accordance with the law of January 6, 1978, amended by the law of August 6, 2004, the User has the right to access and correct the personal data concerning them in Mumade’s files.
No personal information of the user of the site https://www.mumade.fr is published without the user’s knowledge, exchanged, transferred, assigned, or sold to third parties on any medium. Only the potential acquisition of Mumade and its rights would allow the transfer of such information to the potential buyer, who would then be subject to the same obligation of data retention and modification with respect to the user of the site https://www.mumade.fr.

Access to the Site and its use do not imply recognition of any rights, and in general, do not grant any intellectual property rights relating to the Protected Elements, which remain the exclusive property of the Publisher.
The User is prohibited from entering data on the Site that would modify or could modify its content or appearance.
11. Applicable Law and Competent Jurisdiction
The TOU are governed by French law.
In the event of a dispute, and failing an amicable agreement within one (1) month from the occurrence of the dispute, the matter will be brought before the competent courts in Paris.
