Terms of use and legal notice

1. SUBJECT

The purpose of these General Terms and Conditions of Use (hereinafter referred to as " the GTC ") is to define and govern the terms and conditions of use of the www.mumade.fr website (hereinafter referred to as " the Site ") by users (hereinafter referred to as " the Users ").

In order to access the Site and all of its services, you must accept without reservation the present General Conditions of Use in their latest version and comply with them.

2. LEGAL NOTICES

3. SERVICES OFFERED BY THE SITE

The purpose of the Site is the presentation, sale and promotion of the Publisher's products (hereinafter referred to as " the Services "). These Services include:

- The possibility for the User to buy or rent one or more products marketed by the Publisher. To do so, the User must refer to the General Terms and Conditions of Sale made available to him.
- The possibility for the User to subscribe to a newsletter service, allowing him to be regularly informed of the latest news and information relating to the Publisher and its products. To do so, the User must, on the Site, in the Newsletter section, fill in his email address, to which the newsletter will be sent.

5. ACCEPTANCE OF THE GGU

Access to and use of the Site are subject to acceptance of and compliance with the GCU. This acceptance and compliance are deemed to be given by the User on opening the Site.

The GCU apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.

The Publisher reserves the right to modify, at any time and without prior notice, the Site, the Services as well as the GCU, in particular to adapt to the evolution of the Site by making available new functionalities or deleting or modifying existing functionalities.

The User is therefore advised to refer to the latest version of the GCU, which is accessible at any time on the Site, before browsing. In the event of disagreement with the GTC, the User may not use the site.

6. ACCESS AND NAVIGATION

Access to and browsing of the Site, allowing the User to benefit from the Services, is done through an Internet connection.

The Publisher implements the technical solutions at its disposal to allow access to the Site 24 hours a day, 7 days a week.

The Publisher is subject to an obligation of means as regards access to and browsing of the Site and makes its best efforts to guarantee such access and browsing. Nevertheless, the Publisher shall not be held responsible for any malfunctioning of the Site or unavailability of the Services and shall not pay any compensation to the User.

The Publisher may at any time suspend, limit or interrupt access to the Site or to certain pages of the Site in order to carry out updates, modifications to its content or any other action deemed necessary for its proper functioning.

7. RESPONSIBILITIES

The Publisher is only responsible for the content that it has published itself.
However, it cannot guarantee the accuracy, completeness and topicality of the information published on the Site.

The Publisher is not responsible for:
- technical, computer or compatibility problems or failures of the Site with any hardware or software;
- direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use or difficulties in using the Site or the Services;
- the intrinsic characteristics of the Internet, in particular those relating to the lack of reliability and the lack of security of the information circulating on it

The User is responsible for the use and protection of the material he/she uses to browse the Site, for the use he/she makes of the Site and the Services, and for any violation of the TOS.

The following are strictly prohibited (i) any behaviour likely to interrupt, suspend, slow down or prevent the proper functioning of the Site, (ii) any intrusions or attempted intrusions into the Publisher's systems, (iii) any misappropriation of the Site's system resources, (iv) any actions likely to impose a disproportionate burden on the latter's infrastructure, (v) any infringement of security and authentication measures, (vi) any acts likely to infringe the rights and financial, commercial or moral interests of the Editor or the users of its Site, (vii) any practice diverting the Site for purposes other than those for which it was designed and finally more generally (viii) any breach of the TOS or the laws and regulations in force

It is also strictly forbidden to sell or grant access to the Site or any part of it, as well as the information it contains.

In the event of a breach of any of the provisions of this article or, more generally, of laws and regulations, the Publisher reserves the right to take all appropriate measures, to seek damages and to initiate any legal action.

8. HYPERLINKS

The Site may contain hyperlinks to other websites over which the Editor has no control. In spite of the prior and regular checks carried out by the Editor, the latter declines all responsibility for the content that may be found on these sites.

In addition, prior information from the Site Editor is required before any hypertext links can be set up.

Excluded from this authorisation are sites disseminating information of an illicit, violent, polemical, pornographic or xenophobic nature, or which may be harmful to the sensibilities of the majority of people.

Finally, the Publisher reserves the right to remove at any time a hypertext link pointing to its Site, if it deems it not to be in conformity with its editorial policy.

The Publisher is not responsible for transactions between the User and any advertiser to which the User is directed via the Site and shall in no case be a party to any dispute in this regard.

9. DATA COLLECTION AND COOKIES

Personal data

In France, personal data are notably protected by law n° 78-87 of 6 January 1978, law n° 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code and the European Directive of 24 October 1995.
The Personal Data collected by the MUMADE company are processed in accordance with the Regulations in force.

When using the https://www.mumade.fr website, the following information may be collected: the URL of the links through which the user accessed the https://www.mumade.fr website, the user's access provider, the user's Internet protocol (IP) address.

In any case, Mumade only collects personal information about the user for the purpose of certain services offered by the https://www.mumade.fr website. The user provides this information with full knowledge of the facts, in particular when he/she enters it. It is then specified to the user of the site https://www.mumade.fr whether or not they are required to provide this information.

In accordance with the law of 6 January 1978 modified by the law of 6 August 2004, the User has the right to access and rectify personal data concerning him/her in MUMADE files.

No personal information of the user of the website https://www.mumade.fr is published without the user's knowledge, exchanged, transferred, assigned or sold on any medium to third parties. Only the assumption of the repurchase of Mumade and its rights would allow the transmission of the aforementioned information to the possible purchaser who would be in turn held of the same obligation of conservation and modification of the data with respect to the user of the site https://www.mumade.fr

Any representation, reproduction, adaptation or exploitation of the protected elements, in whole or in part, by any means whatsoever, without the prior, express and written authorisation of the Publisher, is strictly prohibited and may constitute an infringement of copyright under the provisions of the Intellectual Property Code.

Any practice known as "webcrowling" is also prohibited

Access to the Site and its use do not constitute recognition of a right and, in general, do not confer any intellectual property right relating to the protected Elements, which remain the exclusive property of the Publisher.

It is forbidden for the User to introduce data into the Site which would modify or which would be likely to modify its content or appearance.

11. APPLICABLE LAW AND JURISDICTION

The GTU are governed by French law.

In the event of a dispute and in the absence of an amicable agreement within one (1) month of the dispute arising, the dispute will be brought before the competent courts of Paris.


These Terms and Conditions of Use supplement the Terms and Conditions of Sale and the Privacy Policy.
